1. About this policy

Study Shack Tutoring (“Study Shack”, “we”, “us”, “our”) provides live online Mathematics tutoring to students in New South Wales. We are committed to protecting your privacy and handling personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

This policy explains what personal information we collect, why we collect it, how we use and disclose it, how we keep it secure, and how you can access, correct or complain about our handling of it. It applies to our website, our enrolment process and our online classes.

2. The information we collect

We only collect personal information that is reasonably necessary to provide tutoring services. This generally includes:

• Parent or guardian details — full name, email address, phone number and postal address (the address is collected for invoicing and accounting purposes).
• Student details — full name, email address, school year level and, for Years 11 and 12, the Mathematics course being studied.
• Enrolment and class information — preferred class, attendance, enrolment history, and any notes you choose to provide in an enquiry.
• Marketing information — how you heard about us, where you have told us.
• Payment records — records of term fees invoiced and paid. We do not store full credit card or bank account numbers.
• Class participation and recordings — see section 5 below.
• Technical information — standard server and log information generated when you visit our website, such as IP address, browser type and pages viewed.

We do not collect sensitive information (such as health information) unless you volunteer it because it is relevant to supporting a student, and only with your consent.

3. How we collect it

We usually collect personal information directly from you — through our free trial and enrolment forms, by email or phone, or during classes. Where a student is under 18, we generally collect their information from a parent or guardian. If you provide us with another person’s details, you should make sure they are aware of this policy.

4. Why we use it

We use personal information to:

• respond to enquiries and arrange free trial lessons;
• enrol students, allocate them to classes and send class invitations and joining links;
• deliver classes and provide access to lesson recordings and materials;
• issue invoices, process payments and keep accounting records;
• communicate with parents and students about timetables, class changes, progress and administration;
• let you know about our other classes, upcoming terms and offers — you can opt out at any time (see section 9);
• improve our teaching, materials and website; and
• meet our legal, tax and record-keeping obligations.

5. Online classes and lesson recordings

Our classes run live online through Microsoft Teams and are recorded so that enrolled students can review them during the term. This means a student’s name, voice, any questions or answers they contribute, and their video if their camera is on, may be captured in a recording.

• Recordings are made available only to students enrolled in that class for that term, and to our tutors and administrators.
• Students and parents must not download, copy, share, publish or redistribute recordings or class links.
• Students may keep their camera off if they prefer. If you do not wish a student to appear in recordings, contact us before their first lesson and we will discuss options.
• Students must not make their own recordings, screenshots or transcripts of a class without our written permission.

By enrolling in a class, you consent to lessons being recorded and used in this way.

6. Who we disclose it to

We do not sell personal information. We may disclose it to:

• Our tutors and administrative staff, so they can teach and support the student;
• Service providers who help us operate — including Microsoft (Teams, for class delivery and recordings), our website and email hosting providers, and our accounting and invoicing software providers;
• Payment providers, who process term fee payments; and
• Others, where required or authorised by law, or where you have consented.

Some of these providers store data on servers located outside Australia. We take reasonable steps to ensure any overseas recipient handles personal information consistently with the Australian Privacy Principles.

7. Security and storage

We hold personal information in electronic form, using reputable service providers. We take reasonable steps to protect it from misuse, interference, loss and unauthorised access, modification or disclosure — including access controls, password protection and limiting access to staff who need it. No method of electronic storage or transmission is completely secure, and we cannot guarantee absolute security.

8. How long we keep it

We keep personal information only for as long as we need it for the purposes described above, or as required by law (financial records, for example, must generally be kept for at least five years). Lesson recordings are retained only for the period students need access to them, and are then deleted in the ordinary course. When information is no longer needed, we take reasonable steps to destroy or de-identify it.

9. Marketing and opting out

If you have enquired or enrolled with us, we may send you occasional information about upcoming terms, classes and offers. Every marketing email includes an unsubscribe link, and you can opt out at any time by emailing hello@studyshack.com.au. Opting out of marketing does not stop essential administrative messages about a current enrolment.

10. Children’s privacy

Our services are provided to school students, most of whom are under 18. We deal primarily with parents and guardians in relation to enrolment, fees and personal information. Where a student has capacity to make their own privacy decisions, we will take that into account; otherwise we will act on the instructions of a parent or guardian.

11. Cookies and website analytics

Our website uses only the cookies necessary for it to function. If we introduce analytics tools to understand how the site is used, any information collected will be aggregated and will not be used to identify individual visitors. You can set your browser to refuse cookies, though parts of the site may not work as intended.

12. Accessing and correcting your information

You can ask us for a copy of the personal information we hold about you or your child, and ask us to correct anything that is inaccurate, out of date or incomplete. Email hello@studyshack.com.au and we will respond within a reasonable period, usually within 30 days. We may need to verify your identity first. If we refuse a request, we will tell you why in writing.

13. Complaints

If you believe we have breached the Australian Privacy Principles, please contact us at hello@studyshack.com.au and set out the details. We will acknowledge your complaint and aim to resolve it within 30 days. If you are not satisfied with our response, you can contact the Office of the Australian Information Commissioner at oaic.gov.au or on 1300 363 992.

14. Data breaches

If we become aware of a data breach that is likely to result in serious harm, we will investigate promptly and notify affected individuals and the Office of the Australian Information Commissioner as required by the Notifiable Data Breaches scheme.

15. Changes to this policy

We may update this policy from time to time. The current version is always available on this page, with the date it was last updated shown at the top. Continued use of our services after a change means you accept the updated policy.
