1. These terms

These Terms & Conditions form the agreement between Study Shack Tutoring (“Study Shack”, “we”, “us”) and the parent or guardian who enrols a student (“you”), and they apply to every class, trial lesson and resource we provide. By booking a trial lesson or enrolling a student, you accept these terms on your own behalf and on behalf of the student.

2. Our classes

• Classes are live, online, group classes in Mathematics for students in Years 7 to 12, delivered through Microsoft Teams.
• Each lesson runs for 90 minutes, once per week, for a 10-week term.
• Classes follow the NSW Mathematics syllabus for the relevant year and course. They supplement, and do not replace, a student’s schooling.
• Class times are published on our timetable. We will tell you the start date for the term when you enrol.

3. Free trial lesson

New students may attend one free trial lesson in a class appropriate to their year level, subject to availability. No payment is required for the trial and there is no obligation to enrol afterwards. We reserve the right to limit trial lessons to one per student.

4. Enrolment

• Enrolment is confirmed once we have accepted your booking and received payment of the term fee.
• Places are limited and are allocated in the order enrolments are confirmed.
• You must provide accurate enrolment details, including a current parent email and phone number and a student email address, and tell us promptly if they change. Class invitations are sent to the student email address you provide.
• We may decline or cancel an enrolment at our discretion, for example where a class is full or not suitable for the student’s year level.

5. Fees and payment

• The fee is $450 per 10-week term per class (approximately $30 per hour).
• Term fees must be paid upfront, in full, before the first lesson of the term. We do not offer per-lesson or pro-rata payment unless we agree otherwise in writing.
• A student’s place is not held until payment is received. We may withdraw a student from a class if fees remain unpaid.
• Where a student enrols after a term has started, we may offer a pro-rata fee for the remaining lessons at our discretion.
• Fees may change from term to term. Any change will be notified before enrolment for the next term opens, and will never affect a term already paid for.

6. Missed classes, refunds and cancellations

• Missed online classes are non-refundable. Term fees reserve a place in a class for the whole term, whether or not the student attends every lesson.
• Every lesson is recorded, and enrolled students have access to the recordings during the term, so a student who misses a lesson can catch up on the content.
• We do not offer make-up lessons, credits or transfers for missed classes.
• If you withdraw a student after the term has started, the balance of the term fee is not refundable.
• If we cancel a lesson and cannot reschedule it or provide a recorded equivalent, we will credit or refund that lesson.
• We may cancel or combine a class that does not reach minimum enrolment numbers. If we do, you will be offered an alternative class or a full refund of the affected lessons.
• Nothing in this section limits your rights under the Australian Consumer Law — see section 13.

7. Technology requirements

Because our classes are delivered online, students are responsible for their own equipment and connection. Before each lesson, students must ensure that:

• their device is fully charged or connected to power for the full 90 minutes;
• they have a stable internet connection capable of supporting live video;
• their device has working sound (speakers or headphones) and a working microphone; and
• they know how to follow the steps we provide to join the online Microsoft Teams class.

We strongly recommend that students follow the joining steps and open the Teams link before the lesson is due to start, to confirm they can access the class without issue. If a student joins from a different device than usual, they should re-test their connection, access, speakers and microphone well before the lesson begins so any problems can be resolved in time.

Lessons start on time. Time lost because a student’s device, connection, sound or access was not working is not refundable and cannot be made up, though the lesson recording will be available.

8. Learning environment and conduct

• Students must join classes from a quiet environment, free from distractions, where they can focus and participate for the full lesson.
• Students are expected to arrive on time, be prepared with the materials needed for the lesson, and take part respectfully.
• Students must treat tutors and other students with courtesy. Disruptive, disrespectful, abusive or inappropriate behaviour is not tolerated.
• Class links, logins and recordings are for the enrolled student only and must not be shared with anyone else.
• Students must not record, screenshot or transcribe any part of a class without our written permission.
• We may remove a student from a lesson, or cancel an enrolment without refund, where behaviour seriously or repeatedly breaches these terms.

9. Lesson recordings and materials

• Lessons are recorded and made available to students enrolled in that class for the duration of the term. Access ends when the term ends unless we say otherwise.
• Recordings, worksheets, notes and other materials remain our intellectual property, or that of their respective owners. They are licensed to the enrolled student for personal study only.
• You must not copy, download, distribute, publish, sell or use our materials or recordings for any commercial purpose, or share them with anyone who is not enrolled in the class.
• Students may appear or be heard in recordings. See our Privacy Policy for how recordings are handled.

10. Supervision and student welfare

Students attend classes from their own home or another location chosen by you, and remain your responsibility throughout the lesson. We are not responsible for supervising students outside the class itself, or for a student’s physical environment, internet safety or wellbeing at their location.

11. Timetable changes

We aim to run every class at its published time. Occasionally we may need to change a class time, date or tutor, or deliver a lesson by recording where a tutor is unavailable. We will give you as much notice as we reasonably can. Classes do not run on public holidays unless we advise otherwise, and any affected lesson will be rescheduled or substituted.

12. Communication

We will communicate with you by email, phone or SMS using the details you provide at enrolment. Class invitations and joining links are sent to the student email address provided. It is your responsibility to check these details are correct and to monitor for our messages, including junk or spam folders.

13. Our services and your rights

We provide tutoring with due care and skill and using experienced mathematics tutors. However, learning outcomes depend on many factors outside our control, including a student’s effort, attendance and school context. We do not guarantee any particular mark, band, ATAR or academic result.

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies those rights. To the extent permitted by law, our liability for any failure to comply with a consumer guarantee is limited to resupplying the service or paying the cost of having it resupplied, and we are not liable for indirect or consequential loss.

14. Privacy

We handle personal information in accordance with our Privacy Policy, which forms part of these terms.

15. Changes to these terms

We may update these terms from time to time. The current version is always published on this page with the date it was last updated. Changes do not apply retrospectively to a term already paid for. Continuing to use our services after a change means you accept the updated terms.

16. Governing law

These terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of that State.
